Legal Question in Criminal Law in Virginia
upgrading charges
a man was charged with malicious wounding and was being held on that charge.the victom died from injuries sustained in the fight.he obviously wont be charged with that anymore.how long does the state have to upgrade this charge before the man will be released.

Likely the original charge may be dropped and the new charge for the homicide will be enacted. No set time frames per se, but normal in Northern Virginia is action within 30 days.
