Legal Question in Criminal Law in Virginia

Violation of Probation 2nd offense

My fiancee has a second offense on his violation of probation. I know he owes fines and when he was a juvenile he was charged as an adult with malicious wounding back in 2003. He is 21 now and they gave him 3 years for this violation. Do you think he should have gotten less time? And can he go back to court. Please answer these questions I dont know where else to look for the answers.

Re: Violation of Probation 2nd offense

Without more information on the specifics of this case, there's really no way to determine whether the imposition of three years is a fair adjudication for this defendant's second probation violation.

Whether it would now be feasible for the defendant to ask the judge to reconsider his sentence would be a question for the attorney who represented him in this matter.
