Legal Question in Criminal Law in Virginia
Under the Virginia statute of 18.2-371, if one is convicted of subsection ii, would registration as a sex offender required? I have searched high and low and the Virginia Sex Offender list of statutes that require registration does not have it as any offense that would require registration. But among more digging, it states that on the 3rd offense that it is upgraded to a class 6 felony and sex offender registration is required. My close friend is currently talking to a 17 year old female and I warned my friend to not pursue this due to the un-clear law regarding it. Can anybody please specify this for me.

So, where exactly did you "dig" and to what authority are you specifically referring for this alleged upgrade in sex offender status based upon a third
conviction of the referenced misdemeanor statute?
