Legal Question in Criminal Law in Virginia

Can a woman legally hit you if you kiss her? I was at work as a line cook in a restaurant when it got really busy. I was walking back and forth to the expedite window to ask the expeditore what we needed to make. The manager, who is a woman, told me not to do that. I kept doing it anyway. She got really upset and ask me to leave. I said i will leave after we get the orders done. So on my way to the window she blocked my way, yelling, pushing, and pointing her finger in my face. I tried to go around her but she kept blocking my way. So to add humor to the situation i kissed her. She hit me in the face so i thought to myself "that didn't work". Then she hit me again and i decided to defend myself and i hit her back twice. She filed class 1 misdemeanor assult and battery (18.2-57) and im pleading self defense.

I would definitely hire an attorney. You need to know how to handle a self defense case.

This case may hinge on what the witnesses have to say. Judge will be the person who decides who is more credible and look at evidence.....etc. You need to know how to introduce evidence correctly. She has the prosecutor on her side. Perhaps you can file your own case against her. Good luck. Sheryl Shane, Attorney at Law. 703 503 4448.
