Legal Question in Criminal Law in Virginia
wrong information on arrest ticket
Cops found a little baggie of weed on me about 3-4 months ago and i was not arrested. I was just told to write a statement and they said they would send the drugs away to get tested. I was arrested on July 2nd for that crime of possession of marijuana, but my arrest papers say that i commited the crime on June 30th!!! Is there anyway out of this? Should I plead not guilty? Although I am a felon for Grand Larceny, this is my first durg charge. I really don't want this on my record. I have witnesses that will testify on my behalf as to when they found the weed on me. Is there a statute of limitations on possession of weed? help please.

Re: wrong information on arrest ticket
The date(s) on the warrant for your arrest may be incorrect but these can easily be amended by the prosecutor.
If you have a prior conviction for grand larceny
and are still in probationary status, your arrest
on this new charge could pose serious trouble and
you should have competent defense counsel to represent you.
The statute of limitations for prosecuting a simple marijuana possession charge is most likely one year.
