Legal Question in Criminal Law in Virginia

Wrongly accused of child abuse

This is the story. A man with 2 children who is married but not to the mother, they had visitation this weekend. The weekend was normal but the mother of the children had the father arrested for ''jerking the son and throwing him across the room''. This did not happen and I am sure he will be cleared of it. My question is, is there charges we can now bring against her for the money we've spent defamation of his character and the slander she has put them through.

Re: Wrongly accused of child abuse

It's interesting that bringing a criminal charge against someone, even if you're cleared is not considered to be slander. Charges have to be cleared through a magistrate or a police officer. This indemnifies the government and prevents you from filing slander charges. This also includes lies that are repeated as testimony.

Sorry.

Good luck.
