Legal Question in Criminal Law in Virginia

I wrote a check from our company account as good faith deposit on a promissory note for money I received. I defaulted on my agreement with the individual and advised him the check was from account that I wasn't supposed to use. He never tried to cash the check but it taking me to court for the money owed to him. My question is can receive legal trouble if my old boss wants to prosecute for writing that check even though I advised it was no good and will be setting up payments after the judgement for the promissory note is granted. This is in Virginia . I was a 50/50 partner in this company

Yes, attempting to obtain something of value, i.e.,money under false pretenses is but one criminal charge which might apply to the situation you've described and for which you might be prosecuted (in my opinion).
