Legal Question in Discrimination Law in Virginia

discriminating against legal alcohol buyers

My grocery store requires an ID of

the 21+ year old and any person

with the legal purchaser. If the other

person is not 21 the sale is refused.

Is that not against the constitution

that says no person over the age of

21 can be discriminated against in

purchasing? Our state law of VA says

it is only illegal to purchase if under

age, not illegal to drink in a private

residence. Is their rule against the

constitution?

The store is acting within its permissible discretion to which it is entitled as a commercial retailer by refusing the kinds of sales which you've described which could lead any reasonable person to conclude that such sales might easily lead to the underage consumption of alcohol by a minor which is illegal in the Commonwealth, no matter where it occurs, even in a private home.
