Legal Question in Discrimination Law in Virginia

discrimination at work

I have been employed by my company for 2 years. I work 12 hr shifts and am usually the only member of management at the facility. When I was hired I was told that I would be working 44 hours a week but I get a 1 hour lunch break. I usually take a nap on my lunch break. Now HR is telling me that I can't take a nap on my break because I am exempt and get paid for my breaks. Furthermore they said that I'm not even guaranteed to get a break. Other exempt and hourly employees are allowed to take a nap on their breaks, but I can't. Would this be considered discrimination?

No, since you're apparently a salaried employee and part of the company's management team, they can tell you how you must spend your break time(irrespective as to how others may be spending theirs---in my opinion).
