Employer racially discriminated against me, can they take my unemployment?

I was fired at my job of two years as a security officer. They said that I released sensitive information, which I did not. I started receiving unemployment benefits. In the meantime I filed a discrimination suit against my employer for racial discrimination. The EOC found that I was racial discriminated against because another employee was allowed to resign and not fired for the same thing. I am currently working another job, but not the unemployment office is saying that they are reversing their decision on my benefits and they want me to pay back the benefits that I received. Can they do this now that they have been found to racially discriminated against me? Might I add that I haven't heard from my employer concerning this suit.

You can (and should) appeal any decision to

require that you pay back any unemployment benefits which you have already received.

You may need the assistance of an attorney to

ensure that your case is properly prepared and presented for the appeal.
