Conviction and penalties
I am facing a first time conviction with a .21 alcohol level. I've been told I face a minimum 5 days in jail. Is this mandatory? Will I be able to travel out of state for work? Can I serve my time on weekend jail? What kind of questions should I ask the judge. What is my best approach in court.

1. Yes there is a mandatory 5 day jail sentence (section 18.2-270 Va. Code)for .20to.25
2. You can be granted a restircted license for work purposes.
3. Weekend time is up to the judge, and usually, the sheriff's requirements.
4. my best advice: GET A LAWYER..a dui is the most expensive misdemeanor that i know of, both in terms of actual money, time , and hassels.
