Legal Question in DUI Law in Virginia

dui plus

im going to court next week for:

1. dui 2nd of. ( last dui was dec.6, 2006)

2. reckless driving 2nd of. ( last one 2001)

3.refusal 2nd of. ( last dec.6, 2006)

4. driving on a revoked licence alcohol related 3rd of.

i was hoping someone could tell me what im looking at.

DUI 2nd within 5 years carries a 20 day mandatory minimum sentence if your BAC was lower than a .15. If your BAC was .15 or greater, then the mandatory minimum punishment would be 10 additional days (30 days total). If your BAC was .20 or greater, then your mandatory minimum punishment would be 20 additional days (40 days total). The maximum sentence could be 12 months in jail.

The reckless driving charge carries a maximum punishment of 12 months in jail. How much jail time you could receive depends on how your were driving in a reckless manner (i.e. 100 MPH in a 55 MPH zone, dangerous lane changes, etc.).

The second offense refusal is a Class 2 misdemeanor (maximum of 6 months in jail) and the court shall suspend the defendant's privilege to drive for a period of three years.
