DUI 3rd offense?
If you are going to court w/o a lawyer for a 3rd dui, one the blood alcohol was only .05% and can I bring up the statue 18.2-269 that states if your blood alcohol is .05% or less it shall be presumed that the accused was not under the influence of alcohol. Also if the person is found guilty, can they appeal the decision w/o a lawyer, and if they do appeal the decision are they held in jail until the appeal is brought to court?
