Legal Question in DUI Law in Virginia

DUI's

My dad just got a second DUI in Virginia within 3 years (all DUI's were in VA), but it's his third total. How much jail time could he face? He is going to try to fight the most recent DUI because the police officer followed him for 10 miles and didn't pull my dad over until he pulled in his driveway.

Upon conviction for his third DUI offense within five years, six months mandatory incarceration in the slammer and a mandatory fine of $1000. (Va. Code Sec. 18.2-270 C 1.)
