Depends upon whether it's a first or subsequent offense and the level of the BAC(Blood Alchol Content)as indicated on the charging document.

For first time offender with BAC less than .15, no jail time mandated.

With BAC between .15 and .20, mandatory minimum of 5 days in jail.

With BAC in excess of .20, mandatory 10 days in the local slammer.
