Legal Question in DUI Law in Virginia

Failure to Appear in Court

I recently recieved an underage alcohol possession charge, and my court date is set while I am going to be on vacation. I called the court and they said that i couldnt get my court date moved for an underage possession of alcohol. I dont know exactly what to do since, i am not going to miss a vacation to Hawaii to go to court. So i was wondering what the best possible way to get around this. I was trying not to get a lawyer if at all possible. Any reccomendations would be greatly appreciated.

Re: Failure to Appear in Court

A defendant is normally entitled to at least one continuance as a matter of course. You should go to the general district court having jurisdiction over your case with a letter addressed to the chief judge requesting the continuance and explaining the circumstances underlying the request.

Present the letter to one of the clerks in the criminal division and then ask if there is anything else you need to do to make your request, formally, to the court, including any other forms you may need to fill out and file.
