good student with underage possession charge in VA

My son's 19 and was charged with underage possession of alcohol after taking 2 sips of beer in a public parking lot. His breathalyzer was .02 and the cops told him to drive himself home after pouring out the beer he had been given by a friend just minutes before. This is his first violation of any sort and he is an all A student in both HS and college. He is on scholarship in college as well. Does he need a lawyer? If not, should he bring his parents along and also bring proof of his good academic record? He also has a good job history. What would most likely be his sentence in VA with and without a lawyer? Thanks in advance.

The person that your son should bring to his scheduled hearing on this charge is the one who most likely will be able to arrange a diposition of his case with the prosecutor which will leave

him without a record of conviction in the matter if

he sucessfully completes his probation as described in Va Code Sec. 4.1-305. And that person

would most likely be a lawyer who is familiar with

these kinds of violations and who is experienced in resolving them.
