I was followed by the same officer for 12-15 miles last night before he finally pulled me over to give me a sobriety test. I pulled into a gas station legitimately to use the bathroom without knowing he had stopped across the street to wait for me. When he pulled me later, he told me I had purposely evaded him, which is not true. If he was so concerned about me being a drunk driver (I eventually blew a .08, and was not intoxicated...will be charged with DWI), why didn't he pull me over sooner? Isn't the idea to get a supposed drunk driver off the street ASAP instead of letting them drive another 10 plus miles and potentially cause and accident?

He wanted to make sure that he had the required level of reasonable suspicion that you were breaking a law before he stopped you. He didn't need to stop you sooner. If you would like a complimentary and confidential legal consultation, please call me at 703.870.6868.
