Legal Question in DUI Law in Virginia

Are prior convictions on my record?

I was charged with a 1st DUI, but I have a prior one in another state (over 2 years ago). How can I find out if the court will know about the prior if I know that my DMV did not find out?

Re: Are prior convictions on my record?

You can reasonably assume that the Commonwealth's prosecutor(s) assigned to your current case will have found out about your prior conviction in the other state by the time your pending DUI case comes up for trial in

Virginia. (Enhanced penalties are required under Virginia law for two DUI convictions within any five year period---irrespective of where they may have occurred.)
