Legal Question in DUI Law in Virginia

Searching for procedure to file for a sentence reduction

I am searching for proper procedure to follow when petitioning for a sentence reduction. I have completed as of February 14, 2002, 73% of my sentence on Home Electronic Monitoring. Any help you could give would be appreciated.

I have followed all the rules, passed all drug and alcohol tests and paid all fines assigned by the courts.

Re: Searching for procedure to file for a sentence reduction

You should consult with the attorney who represented you in this matter. If you did not have a lawyer(which may explain in part why you are now having to seek a reduction), or, for some reason that attorney is no longer available, then you should find another one to represent you in your motion or petition for reduction.

This is not merely a matter of filing forms and reciting rote/boilerplate type arguments, but,

rather requires the creative marshaling of facts supported by relevant law in order to prevail.

It is an exercise in the practice of law for licensed professionals and not for amateurs seeking to save a few bucks.
