Legal Question in DUI Law in Virginia

My wife and I were driving home with two other passengers and she got into an accident. She had a few beers and was at fault for the accident. I got out of the car and talked to the police and other vehicle, and apparently the cops thought I was the one driving; they gave me a field sobriety test and a breathalyzer. I did not make any statement regarding if I was the driver or not because I didn't want to incriminate my wife when there was no need to. I took the field sobriety test yet refused the breathalyzer, and was arrested for DWI. What kind of case do I have?

If your wife and two passengers all come to court and say you weren't driving, then you would have a very strong case on the DUI. It would be interesting to see what the officer wrote in the Criminal Complaint.
