Living Rights

My father and mother deeded their property to myself and two sisters in 1993 and had Living Rights put into the deed for he and my mother. My mother died in September of this year but my father is still living and still living on the property.

My eldest sister is trying to get control of the property saying that ''he's just a tenant, and cannot make any changes to the property.'' My other sister and I would like to ''give our portions back to our father.'' Is this possible to do and what about the other sister? Can we force her to give her portion back to our father so the property can be sold? This property is in the state of Virginia. I am in Texas at the moment.

If the property is in Virginia, then Virginia law would apply. You'll need to check with a Virginia lawyer.
