Legal Question in Entertainment Law in Virginia

Ownership of a music band name

I have a very popular music band, that I started 30 something years ago. Some things in the band have happened, & I want to make sure no one else can use the band's name. What do I need to do to protect it & how much will it cost? I do not know if I need to copywright , or patent, etc...

You will need to obtain a federal trademark protection. You also need to ascertain if someone else is using the name. I would advise to consult an attorney to assist you with this procedure.

Filing fee for a trademark already in use but not registered is generally $325/class if you file electronically. Other costs (your choice, but strongly recommended) include a search and attorney's fees. If you're serious about protecting the mark, do it the right way so you don't end up paying far more down the road.
