Legal Question in Entertainment Law in Virginia
refusal to pay comics
I am a professional stand up of over 16 years experience...I was booked with another comic at a local bar that does not ordinarily do comedy. The club was ill prepared, the crowd uncooperative and rowdy. The owners stopped the show very early into my set (I was the headliner..the feature had already been on). They said they lost money on the night and refused to pay us. Our job was to do a show...not make them money. We fulfilled our obligation by showing up and being prepared to do the show...What recourse do we have under VA law? We were booked by an agency that does the entertainment for the bar, not directly by them. I have offered to take half of the agreed fee, but they refuse to pay amount.

Re: refusal to pay comics
Good Morning,
I would like to learn more about the booking "contract" and customary business practices between the club and agent and the agent and you. It is arguable that the club is obligated to pay, regardless of "popularity". Also, your contract may obligate the booking agent to pay you, regardless of whether or not they get paid.
Best Wishes,

If you think the club was a tough room, just wait till you get to the courthouse with only a verbal agreement (or a written agreement that you didn't pay a lawyer to write).
