If social services has investigated and found no basis for a finding of abuse and neglect, some other adult would have to file a petition alleging that the child is abused or neglected, or requesting that there be a change in custody of the child. The outcome, of course, would depend on the particular facts of the case. No petition should be filed unless facts exist that support the filing of the petition. The petition may be filed with the intake officer of the local juvenile court.
