Legal Question in Family Law in Virginia

My 3 year old son was taken from his mom by CPS a little over a year ago and placed with granddad and he was given Temp Custody while CPS waited to see if his mom would complete what they told her to. She is still working on it. She and I haven't spoken in about that same time period and I haven't been involved in my sons life besides paying child support since he was 3 months old because I was young , and not ready for the responsibility . I didn't know this was happening and Wasn't involved in it and apparently my name was never brought up. I am ready to step up so my son can be with at least one of his parents. Ive held the same job for over 2 years and I have a home and a car and I want to be a father to my son. Since I wasn't involved with the CPS investigation can I go get my son?

No, you cannot just go and get your son in this situation since your son is currently subject to a court's custody order.
