Legal Question in Family Law in Virginia

About 2 years ago I had a daughter at which time I could not care for. I gave her to a couple to care for until I could get back on my feet again. I now would like to have my daughter back. Neither the father or myself ever signed adoption papers or any other papers granting them legal custody. I did write a paper the day she was born giving them the right to seek medical attention when needed. They sent me adoption papers about a year ago to sign and I have not signed them yet. I do not want this couple adopting my daughter. What are my legal rights? Is this something that could turn into an ugly court battle? They live in West Virginia.

Yes, it could turn ugly, very ugly, indeed.

So, send these would be adopters of your daughter a letter explaining that you now would like them to return your daughter to you.

But, in the event that they refuse or ignore your request, then be prepared to litigate the matter in the courts of West Virginia which means that you will likely need to engage the services of an attorney who handles family law issues in that particular state.
