Legal Question in Family Law in Virginia

My 13 yr. old daughter's father (never been married) has been pulled multiple times for DUI's and has had his license suspended only released to him with restrictions and with the purchase of the "breathe alizer" in his car. My question is, "What rights do I have to protect my child, so that she will not be a "statictic" of drinking and driving parents under the influence." We currently have joint custody with physical custody with me. What should I Do?

File a motion to amend the custody which prohibits the father from transporting the daughter in any vehicle which he is driving.
