Legal Question in Family Law in Virginia

adoption

I have temp custody of my grandson and he has been with me since he has been boen and living with me. His mother is serving time in prison in fla. There is no father listed on the birth certificate, and she isn't sure who the father is. One possibiltiy is a minor who will be 18 in nov. If the mother gives up her rights and allows me to adopt him, i & when thid boys decides to do a paternity test and if it happens to be positive can it undo the adoption and allow him into my grandsons life. What can i do?

Re: adoption

No, this putative father would not be able to undue your adoption of your grandson, but if in fact he's found by a court to be the legal father of the child, he could be awarded visitation.

Re: adoption

Correction to word misuse: the first line of the previous answer should read undo rather than "undue".
