Can I sue the person my husband had an affair with for ''tortious interference'' even if we don't get a divorce.

No, the so-called "heart balm" cause of action was excised years ago from the Code Of Virgina and is no longer recognized as a basis for a valid claim

in the Commonwealth. And calling it by another name such as tortious interference will not make it any more actionable than if you referred to it as alienation of affection, or whatever.

You'd still be out of court in no time flat.
