age a child can decide which parent they can live with

at what age can my son decide that he wants to live me instead of his mother. the divorce was in new mexico but he now lives in virgina with his mother and i the dad live in texas

There is no such particular age recognized under Virginia law to determine this particular issue since irrespective of a child's chronological age, each may differ with respect to the multiple factors which a court must consider in making a best interests determination as to where a child should live and with whom.
