Legal Question in Family Law in Virginia

Agreement to pay college tuition

In our separation agreement my ex-husband signed that he would pay up to $3000 for up to 4 years towards college. My daughter has complete 1 year and is now getting married. Does he have to pay the remaining 3 years or does her getting married void the agreement?

Re: Agreement to pay college tuition

Although marriage typically emancipates a child and ends a support obligation, it may not be the case where a party has contractually bound themselves to provide further support--in this case post-majority college expenses. While ultimately a question of contract interpretation, whether or not the expenses will continue is greatly dependent upon the wording of the contract. You may wish to contact a lawyer to review the language and further advise you as to your rights.
