Legal Question in Family Law in Virginia
Alimony for Life and separation agreement
I am 51 and entered into an agreement with my spouse 1 1/2 yrs ago. He wants to change several parts of the agreement. We have only had it notorized and filed with the clerk at the courthouse. Can he change any provisions or do I have to agree? Can we mutually agree to change it or it is set in stone? Also the judge that will hear our case is good friends with my lawyer...can he get the hearing moved to a different court based on that? Also does he have to provide life insurance for me to cover the alimony or does virginia law only require it to cover child support? In our agreement he agreed to 1/2 college, alimony for life unless remarriage occurs, life insurance of 300,000 and much more. Can any of that be changed now or do I have to agree? Even if I do agree can we renegociate the agreement????? Thank you.

Re: Alimony for Life and separation agreement
Any valid PSA(Property Settlement Agreement) can always be changed or renegotiated with the mutual consent of the parties.
If you and your husband have agreed as to virtually all of the important property and other matters in your marriage, it should make no difference who the judge is who presides over your divorce since he will not be involved in these decisions.
As far as I know, your husband would not be required to take out life insurance to guarantee any alimony support obligations referenced in your agreement(unless such is part of the agreement).
