Allimony

I am going to file for a divorce from my husband. Someone said that I may be able to collect allimony, although I do not know what the ''guide lines'' are. He is the Head of our Household, meaning he makes ALOT more money than I do. Any help in this matter would be greatly appreciated.

You may very well be entitled to spousal support (alimony). Different counties in VA use different guidelines to determine whether spousal support is recommended. Even if the guidelines conclude that no spousal support is required you may still be awarded spousal support based on VA law. The court takes many factors into account to determine whether it should grant spousal support. Some of the factors are length of the marriage, the cause of the breakdown of the marriage, the contribution of each the parties during the marriage, his ability to pay and your need, etc.

You should arrange to consult(and be represented) by an attorney knowledgeable in Virginia family law matters, who will inform you,

among many other things, that there are no specific guidelines, unlike in child support, when it comes to spousal support(alimony), and that this is mainly a matter for the court to determine, considering the totality of the circumstances,(assuming that the parties cannot agree).
