Legal Question in Family Law in Virginia

Amending Annual Child Visitation For One Year

My divorce has only been final for 6 days. I am trying to amend my 2002 visitation with my 2 kids from the holidays of 2002 to February 2002 so they may be with me at my wedding. My ex-wife is unwilling to allow that without court interference, but I cant seem to do anything in court until it is too late (i.e. March or April). Is there something I can do to expedite the process, or am I trying to modify the visitation too early after the final decree to get what I want?

Re: Amending Annual Child Visitation For One Year

Depends. If your ex has a lawyer that's remotely reasonable, it should be easy to get an order entered before the wedding IF your ex really has no objection but wants to see the change approved by the court. On the other hand, if the objection is to the kids seeing dad get married so soon after the divorce, it may not be so simple. BUT, since the divorce was obtained in the Circuit Court, and motions are heard in most Circuit Court's every week, and since this should be a matter which can be heard in 30 minutes or less, it should be possible to get the court which granted the divorce to rule on the extra or substitute visitation before the wedding.

Who's your ex's attorney?
