Legal Question in Family Law in Virginia

Appearing for change in custody

My Ex and I have agreed that one of our children move to her home out of state per his request, he is 15. I filed papers for a legal change in physical custody as well as a request for child support review (DCSE has the case). We both received the court papers today, will she and our son need to fly back her to appear, she lives half way across the country ? With this change not being contested can I just appear ? With the child support review can she just fax her documents ?

Re: Appearing for change in custody

If DCSE has responsibility for the case, meaning that an assignment of rights has been executed in favor of the state child support enforcement agency by the payee parent (which permits them to enforce and collect on the support obligation), then you should ask this agency as to whether the payee parent will need to appear and what documentation needs to be submitted for this particular hearing.
