Assault and battery charges how to get divorce after that?

My husband has 2 charges for

assault and battery , after he harm

me.

My question Now, is may I get an

annoulment? we got married 3

months ago in Hawaii.

I am also planning leave the estate,

should I get divorce from my re-

location, or before I leave the estate

I have to file for divorce?

No. merely charges for alleged assault and battery aginst your spouse that have not yet been proven would not be a legal basis for securing an annulment of your marriage to him.

You could get, however, a divorce from your husband based upon no fault grounds either in Virginia or your new state of residence once you have met the statutory requirements such as the required period of separation as well as the other criteria which may be applicable.
