Legal Question in Family Law in Virginia

Assaulted by ex and given child

My cousin was assaulted by his ex. She tried to run him over with a vehicle with the child in the car. My cousin gained custody due to her problems. The judge told him that he was done that day and did not want to see him till oct. that afternoon the police called and said he lost custody because he did not show up for the second part when he was told there was no second part. He told them that they better bring many people to get the child and now is charged with a felony. the child has now been given back to the woman. Does he have a case with the judge telling him he was done and then taking back the child?

Re: Assaulted by ex and given child

Your cousin would be well advised to arrange for a consultation with an attorney who is knowledgeable in family law and procedures as they are practiced in that court which has jurisdiction over the custody issue.

This attorney should be able to sort through the various issues and advise your cousin accordingly.

Well, there are now two cases, aren't there? I would start by purchasing a certified court reporter's transcript of the hearing.
