Legal Question in Family Law in Virginia
assests prior to marriage
I own a home in my name only and it is up for sale. I have recently gotten married, we are in the process of seperating. Does he have any rights to my proceeds from selling my house?
thank you

The simple answer is no, but that may not be entirely correct.
You have what the Virginia Code would define as your separate property, since it was acquired before the marriage. However, if your husband has significantly improved the property with his labor or funds, a portion of the property may be viewed as marital property.
