attorneys fees
I recently paid $1500.00 to reatain an attorney for my son for a custody issue. He was told by the attorney that whatever funds were not used would be refunded. The problem was solved in mediation, so court wasn't necessary. My son received a (1st) bill which showed what money was used and seemed to imply that there was about 1200.00 + money that was left. I wrote to the attorney to see if a refund check would be forwarded to me, since I paid the initial retaining fee. She said that any money remaining, if any, would have to be discussed with my son. I understand that. However, about a week later, my son received another bill which suddenly used up all the funds, plus my son was asked to pay extra. I asked him where the money went. One of the charges was for delivery of court papers to his wife (at workthe other party in the custody dispute), which was only about 15 minutes away. The attorney charged $300.00 for that trip. During this time, my son was also in the process of moving and had his phone disconnected. The attorney charged $40.00 for a phone call to that disconnected number. I'm sure that call couldn't have lasted any more than 30 seconds. These were just a couple examples. There are more. Aren't there any limits?

You should look at the contract to see if the items are covered. Then compare what you know about the time spent by the attorney to what has been billed. Identify any exceptions and speak with the attorney for resolution. You may want to consider a complaint if your analysis shows overbilling. I am a Maryland attorney and would likely not be cost effective with assisting you.
