my new baby

do i have to file for custody of my 3 week old chid if i ask for child support His name is not on the birth cert. the child has my last name but i do want child support i live in virginis in we both are in the navy

No, no need for you to file for formal custody as the law already recognizes you as the legal custodian of this newborn by virtue of your status as the child's natural mother

You can(and should) however, file actions with your local general district court to have the paternity of the father legally established and an order for child support entered against him

which comports with the requirements of the Virginia Child Support Guidelines found at Va. Code Sec. 20-108.2. The court should have the forms

for you to fill out and to file in order for you to get paternity and child support legally established which can be enforced if the father should later default on his support obligations.
