Legal Question in Family Law in Virginia

I just had a baby 3 weeks ago and was wondering how do I file for custody for a newborn in va? Also does the father have to know that I'm filing? We stay together now but as of March 2011 I will have my own place. We will be making arrangements for visitation amongst ourselves.

No need for you to file for custody of your infant if you're current status as natural custodian is not being challenged by the father or anyone else with standing to do so.

As the natural mother of this child, the law already recognizes you as the

proper parent to have these natural custodial rights until a court of proper jurisdiction decides otherwise.

While there is no court order in effect - both parents have one hundred percent right to child. If either of you take the child without the other's permission, serious problems may arise. Ask Attorney Sheryl Shane. www.sherylshane.com.
