Battery is generally defined as an "unprivileged touching", which means that the alleged perpetrator had no right to put his hands upon her as alleged in a manner which was non-consensual, meaning that it was in a manner which she did not agree with.

As to how much time the alleged perpetrator might be facing, upon conviction for this offense, the alleged perpetrator should counsult competent defense counsel for an answer to this question.
