How do you divorce someone if he is already married

Va. Code Sec. 20-38.1 provides the legal basis for annuling such a marriage where one of the parties in the marriage prematurely undertook to marry before his or her prior marriage had been properly dissolved.

You may seek to have the marriage annulled. However, since the second marriage is presumed valid, you must establish bigamy with clear and convincing evidence.
