if a boy is 17 and a girl is 15 can he be proscuted for statuaory rape

Virginia has statutes that address rape, carnal knowledge and contributing to delinquency of minor regarding underage children. Children fourteen years and older can be certified as adults and treated like adults when involved in the judicial process. The state does look at the parties' ages to determine how to charge the individuals involved. Under some statutes, the victim and the alleged perpetrators age is at issue. Best advice - if you are seventeen - do not have sex with fifteen year old girl. You could wind up in trouble.
