Legal Question in Family Law in Virginia
My boyfriend is seeking a divorce from his wife. They have been separated for over 7 years. She left him and has since lived with several guys. He didnt divorce her originally because she was sick and needed his medical insurance (too nice a guy i think). Well now she has her own medical insurance, better than his and he just wants to divorce her.
She is now saying she wants a settlement, we have nothing but his retirement and pension. We live in Virignia (have for over 6 years) and she lives in Texas (has for quite sometime).
She left him with bills (one of which we are being sued for over 35K for a truck her son wrecked).
Does she have any rights or claim to his pension and retirement?

Maybe, maybe not; not enough relevant information provided
to answer this question(in my opinion).
Your boyfriend can still go forward with his divorce (even without her
agreement).
You do not give enough information to answer this. He needs to see an attorney asap.
The pension and retirement may be hybrid property. The issues would probably have to be settled and incorporated into a court decree or be argued at trial. Sheryl Shane, Attorney at Law. www.sherylshanelaw.com. Tel. 703 503 4448.
