Legal Question in Family Law in Virginia

My boyfriend is separated from his wife, but there is no legal separation in place. He lives in Virginia and is being told that no paper work can be filed until after a year of separation. My question then is how do you document your year of separation if no papers are drawn up?

At some point, your boyfriend will have to swear to it other oath and the

written representation to that effect will have to be made in the paperwork which

is filed in the divorce case with the circuit court.

And, FYI, there is no legal status formally recognized in the

Commonwealth as a "legal separation".
