Legal Question in Family Law in Virginia
my brother is in the army reserves. him and his wife have been married for a little over 9 years. he has only been in for 16 months. he is currently on deployment in iraq. he told his wife that he wanted a divorce and expect the papers in 6 months from his deployment date. he and his wife have no property or children together. everything is seperate. since he doesn't need to file for seperation, does the deployment count as them being non-cohabitant?

Yes, it probably can be counted as such(in my opinion).
