Legal Question in Family Law in Virginia

My brother has just started getting his visetation.Now his wife made a claim that my 3 yaer old nease told her that my 10 year old son is making her perform oral sex.My son has not been ther for months.I know its not true.they took my nease to the hospital and a forensic nurs said my nease does not have the knolage to say this.also does not think its true.What kind of charges can come from this?What will happen with my nease?
