Legal Question in Family Law in Virginia

Brother's Separation from Stay At Home Mom

Hi, when my brother and his wife first married, they agreed that she would stay home and raise the three kids while they were small. Money was always very tight for them (medical bankruptcy), and as a consequence, my brother starting working two other jobs in addition to his full time job to support the family. He asked his wife to work to help out, but there was always some excuse why she couldn't/wouldn't work. Now they are getting a divorce (not because of this issue), but my brother still has the 3 jobs, pays ALL of her bills, rent, pays his own rent, and gives her $1,200 a month on top of this - and never has enough money to pay bills on time. She is claiming that he should give her more money, but I find it hard to believe that any judge would try and get MORE money out of him when it is impossible that he work harder. In your opinion, could a judge order him to pay more? Or, would a judge look at the situation and tell the wife to start working?

Thanks.

It's hard to say. You didn't indicate the ages of the children. If they're still relatively young, it may not be feasible or in the children's best interests for the mother leave the home in order to work.
